These Terms and Conditions (the "Terms") govern your access to and use of all websites, pages, and online services that link to or display these Terms (collectively, the "Site"), operated by WEAL28H, LLC ("WEAL28H," "we," "us," or "our"). The Site includes informational content and official updates related to Tetherball Coin ("TBALL"). TBALL is a brand and project operated by WEAL28H and is not a separate legal entity.

The Site is not an exchange, broker, custodian, wallet provider, money transmitter, or payment processor. WEAL28H does not custody digital assets through the Site and does not control user funds or transactions.

You grant WEAL28H a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from your submission in any media solely for operating, improving, and promoting the Site and related communications (including announcements and social posts), unless you and WEAL28H agree otherwise in writing. To the extent permitted by law, you waive any “moral rights” or similar rights in your submission, and you agree you will not be entitled to any compensation for our use of your submission. We may remove or refuse to publish submissions at any time.

WEAL28H may list official channels, but WEAL28H cannot guarantee that third parties will not impersonate TBALL or WEAL28H. You are responsible for verifying official sources.

Consent to receive promotional messages is not a condition of using the Site. You can opt out by following the instructions provided in the message (for example, replying "STOP"). TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAL28H AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, ANY CONTENT, OR ANY THIRD-PARTY SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES EVEN IF LOSSES ARISE FROM HACKS, EXPLOITS, OUTAGES, OR OTHER FAILURES OF ANY THIRD-PARTY SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAL28H’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED USD $100.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless WEAL28H and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or relating to:
WEAL28H may restrict or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these Terms. Upon termination, the license granted to you under these Terms will end.
Sections that by their nature should survive termination will survive, including Sections 4, 6, 7, 8, 9, 10, 11, 12, 13, 16, 17, 18, 20, 21, 22, and 23.
These Terms and any dispute arising out of or relating to these Terms or the Site will be governed by the laws of the State of Wyoming, without regard to conflict of laws principles.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or Content (a "Dispute") will be resolved by binding arbitration on an individual basis and not in court, except that either party may bring an eligible claim in small claims court. This arbitration agreement is governed by the Federal Arbitration Act (FAA).
Before starting arbitration, you agree to contact us at hello@tetherballcoin.com and attempt to resolve the Dispute informally for at least 60 days.
If a Dispute is not resolved informally, it will be resolved by final and binding arbitration administered by JAMS under its applicable rules, conducted by a single arbitrator. Arbitration may be conducted remotely or in-person as determined under the rules.
You and WEAL28H agree that:
Each party will bear its own attorneys’ fees unless a statute requires otherwise. The arbitrator will honor applicable privileges and confidentiality protections. The arbitration will be confidential except as required by law or to enforce an award.
If any portion of this Section 21 is found unenforceable, the remainder will remain in effect to the fullest extent permitted by law.
