These Terms and Conditions (the "Terms") govern your access to and use of all websites, pages, and online services that link to or display these Terms (collectively, the "Site"), operated by WEAL28H, LLC ("WEAL28H," "we," "us," or "our"). The Site includes informational content and official updates related to Tetherball Coin ("TBALL"). TBALL is a brand and project operated by WEAL28H and is not a separate legal entity.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Scope and Purpose

The Site provides general information, educational content, official updates, and announcements related to TBALL and related topics. The Site may also provide links to third-party tools and services (such as wallets, decentralized exchanges, explorers, and social platforms).

The Site is not an exchange, broker, custodian, wallet provider, money transmitter, or payment processor. WEAL28H does not custody digital assets through the Site and does not control user funds or transactions.

2. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site. Changes are effective when posted. It is your responsibility to review these Terms periodically. Your continued use of the Site after any update means you accept the updated Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Content and License

4.1 Content Ownership

All information, text, graphics, images, illustrations, logos, videos, audio, downloads, and other materials available on the Site (collectively, the "Content") are owned by WEAL28H or its licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License

Subject to your compliance with these Terms, WEAL28H grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Site and Content for lawful, personal, and non-commercial purposes only.

4.3 Restrictions

Except where permitted by law or with our prior written consent, you may not:

copy, reproduce, distribute, publicly display, publish, modify, transmit, or create derivative works from the Content
use the Content for commercial purposes
use our logos, brand assets, or artwork in a way that implies sponsorship, affiliation, or endorsement
remove copyright, trademark, or proprietary notices

4.4 Brand and Token References

References to TBALL, Tetherball Coin, and related brand elements are part of WEAL28H’s intellectual property. You may reference TBALL in ordinary discussion and commentary, but you may not use our logos or official artwork as your own branding without permission.

5. Modifications, Availability, and Errors

We may update, modify, suspend, or discontinue any part of the Site at any time without notice. Content may contain errors, omissions, or may not be current. We do not guarantee that Content will be accurate, complete, or up to date, and we reserve the right to correct or update Content at any time.

6. Third-Party Links and Services

The Site may link to third-party websites, applications, platforms, wallets, explorers, decentralized exchanges, social platforms, or other services (each a "Third-Party Service"). Third-Party Services are independent of WEAL28H. We do not control them and are not responsible for their content, availability, security, pricing, legality, functionality, or practices. Links are provided for convenience only and do not imply endorsement or any relationship with the operator of the Third-Party Service. Your use of Third-Party Services is at your own risk and subject to their terms and policies.

7. No Financial, Legal, or Tax Advice

All content on the Site is provided for general informational and educational purposes only. Nothing on the Site constitutes or should be construed as:

financial advice or investment advice
legal advice
tax advice
an offer, solicitation, or recommendation to buy, sell, or hold any asset
an offer or solicitation of securities or any regulated financial product

You are solely responsible for your decisions and actions. You should consult qualified professionals before making financial decisions.

8. Digital Asset Risk Disclosure

Digital assets are volatile and risky. By using the Site, you acknowledge and agree that:

you can lose some or all of your funds
prices may fluctuate significantly and rapidly
blockchain transactions are generally irreversible
you are responsible for confirming wallet addresses, token contract addresses, and transaction details
smart contracts and decentralized protocols may contain vulnerabilities
transactions may be subject to front-running, MEV, slippage, and other execution risks on decentralized markets
networks can experience congestion, delays, downtime, forks, or other unexpected behavior
scams, impersonation, phishing, fake “support,” and malicious links are common in crypto
unsolicited token transfers, “airdrops,” and lookalike tokens can be used to mislead you
regulatory treatment of digital assets may change and may impact availability or value
we do not guarantee that the Site or any Content is accurate, complete, or current, and you should verify information independently

Your use of any digital asset is at your own risk.

9. No Custody; Wallet Responsibility

WEAL28H does not custody your digital assets. WEAL28H does not have access to your private keys, seed phrases, or passwords. You are solely responsible for:

safeguarding your wallet and private keys
verifying transaction details before signing
using official links and verified contract addresses
avoiding phishing, impersonation, and scam attempts

We will never ask you for your seed phrase or private keys.

10. Acceptable Use

You agree not to:

impersonate any person or entity
scrape, crawl, mine, or harvest data or Content from the Site without our written permission
attempt to bypass security or access non-public areas of the Site
upload or transmit malware or harmful code
reverse engineer or attempt to derive source code from the Site or its components
interfere with the Site’s operation or other users’ access
use the Site for unlawful, deceptive, threatening, harassing, abusive, or harmful purposes
violate any third-party rights, including intellectual property or privacy rights

We may restrict or terminate access to the Site if we believe you violated these Terms.

11. User Submissions

If you submit content to WEAL28H through the Site or related channels (including messages, comments, or media), you represent that (a) you have the right to submit it, and (b) it does not violate any law or third-party rights. You understand that submissions may be public and may be re-shared by others, and you should not submit anything you consider confidential.

You grant WEAL28H a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and create derivative works from your submission in any media solely for operating, improving, and promoting the Site and related communications (including announcements and social posts), unless you and WEAL28H agree otherwise in writing. To the extent permitted by law, you waive any “moral rights” or similar rights in your submission, and you agree you will not be entitled to any compensation for our use of your submission. We may remove or refuse to publish submissions at any time.

12. Copyright Complaints

If you believe any content on the Site infringes your copyright, contact us at hello@tetherballcoin.com and include:

your contact information
identification of the copyrighted work
identification of the allegedly infringing material and its location
a good faith statement that the use is not authorized
a statement under penalty of perjury that your notice is accurate
your signature (physical or electronic)

13. Privacy

Your use of the Site is subject to our Privacy Policy, if posted, which is incorporated by reference. If no Privacy Policy is posted, you acknowledge that information you submit may be processed for Site administration and communications.

14. Official Communications and Scam Awareness

Impersonation and scams are common in crypto. You agree to use caution, verify authenticity, and avoid sharing private information. We will never ask you for your seed phrase or private keys.

WEAL28H may list official channels, but WEAL28H cannot guarantee that third parties will not impersonate TBALL or WEAL28H. You are responsible for verifying official sources.

15. SMS and Messaging

If we offer SMS or messaging in the future, you may receive transactional or promotional messages if you opt in, or as otherwise permitted by law. Message and data rates may apply. Consent to receive promotional messages is not a condition of using the Site. You can opt out by following the instructions provided in the message (for example, replying "STOP"). Opting out of promotional messages does not prevent us from sending important administrative, transactional, or security-related notices.

16. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAL28H AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, ANY CONTENT, OR ANY THIRD-PARTY SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES EVEN IF LOSSES ARISE FROM HACKS, EXPLOITS, OUTAGES, OR OTHER FAILURES OF ANY THIRD-PARTY SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEAL28H’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless WEAL28H and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or relating to:

your access to or use of the Site
your violation of these Terms
your violation of any law or third-party right
your use of any Third-Party Service
your submissions or content you provide

19. Termination

WEAL28H may restrict or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these Terms. Upon termination, the license granted to you under these Terms will end.

Sections that by their nature should survive termination will survive, including Sections 4, 6, 7, 8, 9, 10, 11, 12, 13, 16, 17, 18, 20, 21, 22, and 23.

20. Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Site will be governed by the laws of the State of Wyoming, without regard to conflict of laws principles.

21. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or Content (a "Dispute") will be resolved by binding arbitration on an individual basis and not in court, except that either party may bring an eligible claim in small claims court. This arbitration agreement is governed by the Federal Arbitration Act (FAA).

21.1 Informal Resolution

Before starting arbitration, you agree to contact us at hello@tetherballcoin.com and attempt to resolve the Dispute informally for at least 60 days.

21.2 Arbitration Rules and Forum

If a Dispute is not resolved informally, it will be resolved by final and binding arbitration administered by JAMS under its applicable rules, conducted by a single arbitrator. Arbitration may be conducted remotely or in-person as determined under the rules.

21.3 No Class Actions

You and WEAL28H agree that:

Disputes must be brought only in an individual capacity
the arbitrator may not consolidate claims or preside over any class, collective, or representative proceeding
the arbitrator may award relief only on an individual basis

21.4 Fees and Confidentiality

Each party will bear its own attorneys’ fees unless a statute requires otherwise. The arbitrator will honor applicable privileges and confidentiality protections. The arbitration will be confidential except as required by law or to enforce an award.

21.5 Severability

If any portion of this Section 21 is found unenforceable, the remainder will remain in effect to the fullest extent permitted by law.

22. Miscellaneous

Entire Agreement. These Terms constitute the entire agreement regarding your use of the Site.
Severability. If any provision is unenforceable, the remaining provisions remain in effect.
No Waiver. Failure to enforce any provision is not a waiver.
Assignment. You may not assign these Terms without our consent. WEAL28H may assign these Terms without restriction.
Headings. Headings are for convenience only and do not affect interpretation.
Electronic Communications. By using the Site, you consent to receive communications from us electronically (for example, by email or by posting notices on the Site). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
